Court frees Polye
Court ousted Kandep Member of Parliament Don Polye is a free man after the Waigani District Court dismissed three major criminal charges against him on Tuesday morning.
Magistrate Paul Nii struck out the charges of official corruption, conspiracy to defeat justice, and attempting to pervert the course of justice, ruling that the prosecution failed to provide sufficient evidence to move the case forward.
This high-profile case, which originally centered around alleged procurement irregularities involving state contracts and the PNG Sports Foundation, ultimately collapsed in court due to what the defense highlighted as critical legal errors by the prosecution.
Speaking outside the courtroom, expert defense lawyer Edward Sasingian revealed that the Independent Commission Against Corruption [ICAC] had applied the wrong provisions of the law against his client.
The defense team successfully argued that the prosecution's case fell apart because the actions of a political minister did not meet the strict legal definitions required to legally prove an abuse of office charge.
Following the decision, a visibly relieved Don Polye welcomed the ruling as a major legal victory, stating that the decision finally lifts a "dark cloud" over his political leadership and completely clears his name.
